This Legal Disclaimer applies to all products sold or distributed by 3D Safe Solutions, including but not limited to SwitchMate products. References to “products” include all accessories, components, and aftermarket items manufactured or sold by the Company.

By purchasing, installing, or using any product sold by 3D Safe Solutions, you acknowledge and agree to the terms outlined below.

General Product Disclaimer

All products sold by 3D Safe Solutions are intended as driver-convenience accessories only. They are not safety devices, security devices, restraint systems, or fail-safe mechanisms.

No product sold by 3D Safe Solutions is designed, marketed, or warranted to:

• Prevent injury or death
• Prevent property damage
• Prevent theft, vandalism, or unauthorized access
• Guarantee containment, control, or supervision of pets
• Prevent unauthorized operation of vehicle controls

Use of any product is at the sole risk of the user.

No Implied Warranties

Except as expressly stated in the Warranty & Returns Policy, all products are provided “as is” and “as available.”

To the maximum extent permitted by law, 3D Safe Solutions disclaims all implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. No oral or written statements made by the Company, its representatives, or its marketing materials shall be construed as creating any warranty beyond what is expressly stated in the Warranty & Returns Policy.

Installation & Use Disclaimer

Installation and use of products sold by 3D Safe Solutions are the sole responsibility of the customer.

The Company is not responsible or liable for damage resulting from improper installation, incorrect orientation, installation on an incompatible vehicle, failure to follow instructions, misuse, abuse, negligence, or user error. Customers are responsible for verifying vehicle compatibility, correct installation, and safe operation at all times.

Any installation guidance, instructions, or recommendations provided by 3D Safe Solutions are informational only and do not constitute professional, mechanical, or safety advice.

Performance & Environmental Disclaimer

Products may experience wear, degradation, or changes in performance over time due to normal use, environmental exposure, or external factors. Continuous or uninterrupted performance is not guaranteed.

3D Safe Solutions is not responsible for product performance changes, damage, or failure caused by environmental conditions, including but not limited to:

• Extreme heat or cold
• Prolonged sun or UV exposure
• Humidity or moisture
• Road vibration or vehicle operation
• Long-term use or storage conditions

Injury, Medical & Veterinary Cost Disclaimer

3D Safe Solutions shall not be held liable for injury, death, bodily harm, or medical conditions affecting any person or pet.

The Company is not responsible for medical bills, hospital expenses, veterinary costs, rehabilitation fees, or related damages arising from the use, misuse, or failure of any product, including incidents involving persons or pets falling, jumping, or exiting a vehicle through an open or partially open window.

Pet & Passenger Responsibility Disclaimer

The driver or vehicle operator remains solely responsible for the supervision, safety, and control of all passengers and pets at all times.

3D Safe Solutions shall not be held liable for any injury, loss, or damage resulting from a pet or passenger opening, manipulating, bypassing, defeating, or otherwise circumventing a product, or interacting with vehicle controls.

Products sold by the Company do not guarantee containment of pets or prevention of passenger interaction with vehicle systems.

Lost or Missing Pet Disclaimer

3D Safe Solutions is not responsible or liable for any pet that becomes lost, missing, injured, or unrecovered as a result of a pet opening, bypassing, defeating, or otherwise circumventing a product sold by the Company.

This includes, but is not limited to, situations where a pet exits a vehicle through an open or partially open window, regardless of whether a product is installed, used as intended, or functioning at the time of the incident.

The driver assumes all responsibility for pet supervision, containment, recovery efforts, and any associated emotional, financial, or logistical consequences.

Vehicle Lockout & Associated Costs Disclaimer

3D Safe Solutions shall not be held liable for any loss, damage, inconvenience, or expense resulting from a vehicle being locked while the driver or operator is outside of the vehicle.

This includes situations where a pet or passenger activates door locks or vehicle controls, whether intentionally or unintentionally. 3D Safe Solutions is not responsible for locksmith fees, tow truck charges, roadside assistance costs, emergency service fees, lost time, missed loads, delays, or related expenses.

The driver remains solely responsible for maintaining access to and control of the vehicle at all times.

Vehicle, Cargo & Property Disclaimer

3D Safe Solutions is not responsible or liable for damage to vehicles, trailers, cargo, freight, personal property, or vehicle contents. This includes loss or damage resulting from theft, attempted theft, vandalism, unauthorized access, accidents, environmental exposure, or criminal acts.

Use of a product does not create any duty or obligation on the Company to protect property or prevent loss.

Manufacturing Process & Cosmetic Disclaimer

Certain products sold by 3D Safe Solutions are manufactured using additive manufacturing (3D printing).

As a result:

• Cosmetic appearance may vary between products
• Surface texture, layer lines, and visual inconsistencies are normal
• Minor cosmetic variations do not affect functionality

Such variations are inherent to the manufacturing process and do not constitute defects or grounds for warranty claims, returns, or refunds.

Company Driver & Employer Authorization Disclaimer

Products sold by 3D Safe Solutions are aftermarket accessories.

The Company does not represent or guarantee that installation of its products is approved by any trucking company, motor carrier, fleet operator, or employer. Company drivers install and use products at their own risk.

Drivers are solely responsible for obtaining employer authorization, ensuring compliance with company policies, lease agreements, and fleet rules, and assuming responsibility for installation, use, and any damage caused to company-owned vehicles, equipment, or interiors, as well as any disciplinary or employment consequences.

Assumption of Risk

By purchasing and using any product sold by 3D Safe Solutions, the customer knowingly and voluntarily assumes all risks associated with installation, use, and operation of the product. No product eliminates risk or guarantees safety.

Limitation of Liability

To the maximum extent permitted by law, 3D Safe Solutions shall not be liable for direct, indirect, incidental, consequential, or punitive damages, including but not limited to loss of use, loss of income, medical or veterinary expenses, emotional distress, property damage, or criminal acts.

Total liability, if any, shall be limited solely to the amount paid for the original product purchased.

Severability

If any provision of this Legal Disclaimer is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement

This Legal Disclaimer, together with the Warranty & Returns Policy and Shipping Policy, constitutes the entire agreement between the customer and 3D Safe Solutions regarding product use, liability, and risk allocation.

Policy Modifications

3D Safe Solutions reserves the right to modify or update this Legal Disclaimer at any time without prior notice. The version in effect at the time of purchase or use shall govern.

Governing Law & Venue

This Legal Disclaimer shall be governed by and construed in accordance with the laws of the State of Idaho. Any disputes arising from this Disclaimer shall be brought exclusively in the state or federal courts located within the State of Idaho.
